VỊ TRÍ VÀ CHỨC NĂNG

Điều 1. Vị trí và chức năng

1. Vị trí:

Phòng Kinh tế Quận 8 là cơ quan chuyên môn thuộc Ủy ban nhân dân Quận 8; chịu sự chỉ đạo, quản lý trực tiếp, toàn diện về tổ chức, biên chế và công tác của Ủy ban nhân dân Quận 8; đồng thời chịu sự hướng dẫn, kiểm tra về chuyên môn, nghiệp vụ của Sở Nông nghiệp và Phát triển nông thôn, Sở Công Thương, Sở Khoa học và Công nghệ, Sở Kế hoạch và Đầu tư.

Phòng Kinh tế Quận 8 có tư cách pháp nhân, có con dấu và tài khoản riêng.

2. Chức năng:

Phòng Kinh tế Quận 8 có chức năng tham mưu, giúp Ủy ban nhân dân Quận 8 thực hiện quản lý nhà nước về các lĩnh vực: tiểu thủ công nghiệp; khoa học và công nghệ; công nghiệp; thương mại; dịch vụ; quản lý năng lượng; đăng ký kinh doanh; tổng hợp, thốngnhất quản lý về kinh tế hợp tác xã, kinh tế tập thể, kinh tế tư nhân; chợ, quảnlý nhà nước về điện.

Chương II

NHIỆM VỤ VÀ QUYỀN HẠN

Điều 2.Nhiệm vụ và quyền hạn

Phòng Kinh tế Quận 8 có nhiệm vụ và quyền hạn sau đây:

1. Nhiệm vụ và quyền hạn chung thuộc các lĩnh vực quản lý nhà nước được giao:

a) Trình Ủy ban nhân dân Quận 8 dự thảo quyết định, chỉ thị; quy hoạch, kế hoạch dài hạn, 5 năm và hàng năm về phát triển các ngành trên địa bàn Quận 8 theo chức năng, nhiệm vụ của Phòng; chương trình, biện pháp tổ chức thực hiện các nhiệm vụ cảicách hành chính nhà nước và phân cấp quản lý trong lĩnh vực được giao trên địabàn. Dự toán ngân sách nhà nước hàng năm cho lĩnh vực quản lý nhà nước đượcphân công;

b) Tổ chức thực hiện các văn bản quy phạm pháp luật, quy hoạch, kế hoạch, nhiệm vụ cải cách hành chính về lĩnh vực được phân công sau khi được ban hành, phê duyệt; thông tin, tuyên truyền, giáo dục, phổ biến, hướng dẫn văn bản pháp luật, cơ chế, chính sách, chuyên môn, nghiệp vụ trong lĩnh vực thuộc phạm vi quản lýđược giao;

c) Giúp Ủy ban nhân dân Quận 8 quản lý nhà nước đối với hoạt động của các thành phần kinh tế trên địa bàn Quận 8 trong phạm vi lĩnh vực các ngành kinh tế được phân công; hướng dẫn và kiểm tra hoạt động của các hội và tổ chức phi chính phủ trên địa bàn thuộc lĩnh vực quản lý nhà nước được phân công;

d) Hướng dẫn chuyên môn, nghiệp vụ về lĩnh vực được phân công cho cán bộ, công chức phường trên địa bàn Quận 8;

đ) Giúp Ủy ban nhân dân Quận 8 thực hiện và chịu trách nhiệm về việc thẩm định, đăng ký, cấp và thu hồi giấy chứng nhận đăng ký kinh doanh, các loại giấy phép thuộc phạm vi trách nhiệm và thẩm quyền của Phòng theo quy định của pháp luật và theo phân công của Ủy ban nhân dân Quận 8;

e) Được quyền yêu cầu các cơ quan, đơn vị thuộc Quận 8 và Ủy ban nhân dân phường cung cấp số liệu có liên quan đến lĩnh vực quản lý thuộc chức năng, nhiệm vụ của Phòng; thực hiện công tác thông tin, báo cáo định kỳ và đột xuất liên quan đến chức năng, nhiệm vụ được giao của Phòng theo quy định của Ủy ban nhân dân Quận 8 và các Sở - ngành liên quan;

g) Chủ trì, phối hợp với các cơ quan liên quan kiểm tra, thanh tra và đề xuất xử lý vi phạm đối với các tổ chức, cá nhân trong việc chấp hành pháp luật thuộc các lĩnh vực được phân công trên địa bàn; giải quyết khiếu nại, tố cáo; phòng, chống tham nhũng, lãng phí trong hoạt động các lĩnh vực được phân công trên địa bàn theo quy định của pháp luật và phân cấp của Ủy ban nhân dân Quận 8;

h) Tổ chức triển khai, ứng dụng tiến bộ khoa học, công nghệ; hỗ trợ các tổ chức kinh tế tập thể, kinh tế tư nhân đóng trên địa bàn trong việc triển khai, ứng dụng tiến bộ khoa học, công nghệ; xây dựng hệ thống thông tin, lưu trữ phục vụ công tác quản lý nhà nước và chuyên môn, nghiệp vụ của Phòng;

i) Quản lý tài chính, tài sản của Phòng theo quy định của pháp luật và phân cấp của Ủy ban nhân dân Quận 8;

k) Theo dõi, tổng hợp, báo cáo định kỳ 6 tháng, 1 năm và đột xuất về tình hình thực hiện nhiệm vụ được giao với Ủy ban nhân dân Quận 8, Sở Công Thương, Sở Khoa học và Công nghệ, Sở Kế hoạch và Đầu tư, Sở Nông nghiệp và Phát triển nông thôn và các cơ quan có thẩm quyền khác theo quy định của pháp luật.

2. Nhiệm vụ, quyền hạn cụ thể về kinh tế tập thể, kinh tế tư nhân:

a) Giúp Ủy ban nhân dân Quận 8 thực hiện và chịu trách nhiệm về việc thẩm định, đăng ký,cấp và thu hồi giấy chứng nhận đăng ký kinh doanh, các loại giấy phép theo phân công của Ủy ban nhân dân Quận 8; thực hiện và chịu trách nhiệm về việc thẩm định đăng ký, cấp và thu hồi giấy phép kinh doanh bán lẻ (hoặc đại lý bán lẻ) thuốc lá, sản xuất và kinh doanh rượu thuộc phạm vi trách nhiệm và thẩm quyền của Phòng theo quy định của pháp luật;

b) Tổ chức, hướng dẫn và thực hiện chính sách khuyến khích các tổ chức kinh tế tập thể, kinh tế tư nhân đầu tư phát triển hoạt động sản xuất kinh doanh; tổ chức các hoạt động dịch vụ tư vấn chuyển giao công nghệ, cung cấp thông tin, xúc tiến thương mại và đào tạo nguồn nhân lực cho các cơ sở sản xuất kinh doanh trên địa bàn;

c) Tổng hợptheo dõi, đánh giá tình hình thực hiện các chương trình, kế hoạch, cơ chế, chính sách phát triển kinh tế tập thể, kinh tế tư nhân và hoạt động của các tổ chức kinh tế tập thể, kinh tế tư nhân trên địa bàn Quận 8.

3. Nhiệm vụ, quyền hạn cụ thể về khoa học - công nghệ và năng lượng:

a) Trình Chủ tịch Ủy ban nhân dân Quận 8 quyết định thành lập Hội đồng khoa học và công nghệ theo quy định tại Luật Khoa học và công nghệ, hướng dẫn của Bộ Khoa học và Công nghệ và làm thường trực Hội đồng khoa học và công nghệ của Ủy ban nhân dân Quận8;

b) Phát triển phong trào lao động sáng tạo, phổ biến, lựa chọn các tiến bộ khoa học và công nghệ, các kết quả nghiên cứu khoa học và phát triển công nghệ, các sáng chế, sáng kiến, cải tiến kỹ thuật, hợp lý hóa sản xuất để hỗ trợ áp dụng tại các cơ quan, tổ chức, doanh nghiệp trên địa bàn Quận 8; tổ chức thực hiện các dịch vụkhoa học và công nghệ trên địa bàn. Theo dõi, giám sát, phối hợp và hỗ trợ các đơn vị tổ chức thực hiện các dự án chuyển giao công nghệ vào sản xuất và đờisống trên địa bàn;

c) Quản lý nhà nước đối với hoạt động tiêu chuẩn, đo lường, chất lượng, sở hữu trí tuệ, ứng dụng bức xạ và đồng vị phóng xạ; an toàn bức xạ, hạt nhân theo quy định củapháp luật và theo hướng dẫn của Sở Khoa học và Công nghệ;

d) Xây dựng hệ thống thông tin, thống kê, lưu trữ về khoa học và công nghệ tại địa phương theo hướng dẫn của Sở Khoa học và Công nghệ;

đ) Triển khai thực hiện quy hoạch, chính sách, kế hoạch phát triển điện lực, phát triển việc ứng dụng năng lượng mới, năng lượng mặt trời, năng lượng gió và các dạng năng lượng khác trên địa bàn quản lý;

e) Triển khai thực hiện quy hoạch, kế hoạch nghiên cứu, phát triển sản xuất và sử dụng tiết kiệm, hiệu quả năng lượng trên địa bàn quản lý;

g) Tổ chức triển khai thực hiện quy định về quản lý hoạt động điện lực trên địa bàn; các quy định về hành lang bảo vệ an toàn lưới điện cao áp và các công trình điện khác trên địa bàn quản lý;

h) Tổ chức tập huấn kiến thức pháp luật về hoạt động điện lực và sử dụng điện, tập huấn về hoạt động sử dụng năng lượng tiết kiệm, hiệu quả và an toàn điện cho cán bộquản lý năng lượng, cán bộ và nhân viên của các doanh nghiệp, các cơ sở sản xuất và các tổ chức quản lý điện trên địa bàn; hướng dẫn và kiểm tra việc ápdụng tiêu chuẩn, quy chuẩn, quy phạm an toàn điện trong hoạt động sử dụng nănglượng tiết kiệm, hiệu quả, hoạt động điện lực và sử dụng điện, các quy trình,quy định về an toàn điện áp dụng trong nội bộ cơ quan, doanh nghiệp;

i) Tổ chứctriển khai thực hiện phương án giá điện trên địa bàn quản lý. Phối hợp với cơ quan nhà nước có thẩm quyền thực hiện kiểm tra, thanh tra chuyên ngành điện lực theo quy định của pháp luật và xử lý các hành vi vi phạm pháp luật trong lĩnhvực năng lượng.

4. Nhiệm vụ, quyền hạn cụ thể về nông nghiệp và phát triển nông thôn:

a) Phối hợp công tác phòng, chống, khắc phục hậu quả thiên tai, sâu bệnh, dịch bệnh trên địa bàn;

b) Phối hợp các cơ quan liên quan tổ chức bảo vệ công trình phòng, chống lũ, lụt, bão;

c) Thực hiện các biện pháp chuyển dịch cơ cấu kinh tế;

d) Tổng hợp tình hình, báo cáo Ủy ban nhân dân quận việc xây dựng và phát triển kinh tế hợp tác, hợp tác xã;

5. Thực hiện một số nhiệm vụ khác:

a) Tham mưu Ủy ban nhân dân Quận 8 xây dựng và tổ chức thực hiện quy hoạch phát triển chợ, siêu thị, trung tâm thương mại, các cửa hàng thương mại trên địa bàn Quận 8; Giúp Ủy ban nhân dân Quận 8 thực hiện quản lý nhà nước đối với chợ, siêu thị, trung tâm thương mại, các cửa hàng thương mại trên địa bàn Quận 8;

b) Phối hợp với Phòng Nội vụ tham mưu và đề xuất Ủy ban nhân dân Quận 8 về công tác nhân sự Ban quản lý các chợ trên địa bàn Quận 8.

c) Thực hiện một số nhiệm vụ khác về các lĩnh vực quản lý nhà nước thuộc ngành theo sự phân công, phân cấp hoặc ủy quyền của Ủy ban nhân dân Quận 8 và theo quy định của pháp luật.

Chương III

CƠ CẤU TỔ CHỨC VÀ BIÊN CHẾ

Điều 3. Cơ cấu tổ chức

1. Phòng Kinh tế Quận 8 có Trưởng phòng và không quá 03 Phó Trưởng phòng.

a) Trưởng phòng chịu trách nhiệm trước Ủy ban nhân dân, Chủ tịch Ủy ban nhân dân Quận 8 và trước pháp luật về toàn bộ hoạt động của Phòng, đồng thời chịu trách nhiệm trước Giám đốc các Sở liên quan về thực hiện các mặt công tác chuyên môn của Phòng;

b) Phó Trưởng phòng là người giúp Trưởng phòng, chịu trách nhiệm trước Trưởng phòng và trước pháp luật về các nhiệm vụ được phân công. Khi Trưởng phòng vắng mặt, một Phó Trưởng phòng được Trưởng phòng ủy quyền điều hành các hoạt động của Phòng;

c) Việc bổ nhiệm Trưởng phòng, Phó Trưởng phòng do Chủ tịch Ủy ban nhân dân Quận 8 quyết định theo tiêu chuẩn chuyên môn, nghiệp vụ; việc miễn nhiệm, khen thưởng, kỷ luật Trưởng phòng, Phó Trưởng phòng thực hiện theo quy định của pháp luật.

d) Cán bộ, công chức chuyên môn, nghiệp vụ được bố trí tương xứng với nhiệm vụ được giao.

2. Phòng Kinh tế Quận 8 được tổ chức thành 5 Tổ công tác, gồm những công chức được phân công đảm nhiệm các chức danh công việc trên các mặt công tác của Phòng:

- Tổ quản lý chợ, siêu thị, trung tâm thương mại;

- Tổ quản lý Đăng ký Kinh doanh;

- Tổ quản lý Khoa học - Công nghệ và Năng lượng;

- Tổ quản lý Kinh tế hợp tác xã, Kinh tế tập thể, Kinh tế tư nhân.

- Tổ quản lý Công nghiệp, Thương mại, Dịch vụ;

- Tổ hành chính quản trị, giải quyết đơn thư khiếu nại - tố cáo.

Điều 4. Biên chế

Căn cứ vào khối lượng công việc và tình hình cán bộ cụ thể để xác định từng chức danh và tiêu chuẩn nghiệp vụ công chức để phân bổ biên chế cho phù hợp, đảm bảo thực hiện và hoàn thành nhiệm vụ được giao.

Số lượng biên chế cụ thể làm công tác quản lý ngành của Phòng Kinh tế do Chủ tịch Ủy ban nhân dân Quận 8 quyết định trong tổng biên chế hành chính của Quận 8 trên cơ sở chỉ tiêu biên chế hành chính được Ủy ban nhân dân Thành phố giao cho Quận 8 hàng năm.

Cán bộ, công chức Phòng Kinh tế Quận 8 có chức danh, nhiệm vụ cụ thể, có bảng tên đặt tại nơi làm việc, có đeo thẻ công chức theo quy định. Cán bộ, công chức phải có thái độ, phong cách làm việc lịch sự, tận tụy, khiêm tốn, tôn trọng và lắngnghe ý kiến của lãnh đạo Phòng, đồng nghiệp và các tổ chức hoặc cá nhân đến liên hệ công tác.

Chương IV

CHẾ ĐỘ LÀM VIỆC VÀ QUAN HỆ CÔNG TÁC

Điều 5.Chế độ làm việc

1. Trưởng phòng phụ trách, điều hành tất cả các hoạt động của Phòng và phụ trách công tác trọng tâm. Các Phó Trưởng phòng phụ trách và trực tiếp giải quyết các công tác được Trưởng phòng phân công;

2. Khi giải quyết công việc thuộc lĩnh vực mình phụ trách có liên quan đến nội dung chuyên môn của Phó Trưởng phòng khác, Phó Trưởng phòng chủ động bàn bạc thống nhất hướng giải quyết, chỉ trình Trưởng phòng quyết định các vấn đề chưa nhất trí với các Phó Trưởng phòng khác hoặc những vấn đề mới phát sinh mà chưa có chủ trương, kế hoạch và biện pháp giải quyết;

3. Trongt rường hợp Trưởng phòng trực tiếp yêu cầu các cán bộ, chuyên viên giải quyếtcông việc thuộc phạm vi thẩm quyền của Phó Trưởng phòng, yêu cầu đó được thực hiện nhưng cán bộ, chuyên viên giải quyết phải báo cáo cho Phó Trưởng phòng trực tiếp phụ trách biết.

Điều 6. Chế độ sinh hoạt hội họp

1. Hàng tuần, lãnh đạo Phòng họp giao ban một lần để đánh giá việc thực hiện nhiệm vụ và phổ biến kế hoạch công tác cho tuần sau.

2. Sau khi giao ban lãnh đạo Phòng, các bộ phận họp với Phó Trưởng phòng trực tiếp phụ trách để đánh giá công việc, bàn phương hướng triển khai công tác và thống nhất lịch công tác.

3. Mỗi tháng họp toàn thể cơ quan một lần.

4. Mỗi thành viên trong từng bộ phận có lịch công tác do lãnh đạo Phòng trực tiếp phê duyệt.

5. Lịch làm việc với các cơ sở của Phòng (các tổ chức và cá nhân có liên quan) phải nêu cụ thể trong lịch công tác hàng tuần, tháng của đơn vị; nội dung làm việc được Phòng chuẩn bị chu đáo để kịp thời giải quyết có hiệu quả các yêu cầu phát sinh liên quan đến hoạt động chuyên môn của Phòng.

6. Phòng Kinh tế có thể tổ chức họp đột xuất để triển khai công việc cần thiết và cấp bách theo yêu cầu của Ủy ban nhân dân Quận 8 hoặc lãnh đạo các Sở - ngành thành phố có liên quan.

Điều 7.Chế độ thông tin báo cáo

Theo định kỳ (hoặc đột xuất), các đơn vị có liên quan có trách nhiệm thực hiện việc báo cáo tình hình hoạt động, thống kê số liệu liên quan đến lĩnh vực của cơ quan, đơn vị mình về Phòng Kinh tế để phục vụ cho việc tổng hợp báo cáo hoặc tham mưu báo cáo theo quy định.

Điều 8. Mối quan hệ công tác

1. Đối với Ủy ban nhân dân Quận 8:

- Phòng Kinh tế chịu sự lãnh đạo, chỉ đạo trực tiếp và toàn diện của Ủy ban nhân dân Quận 8 về toàn bộ công tác theo chức năng, nhiệm vụ của Phòng, Trưởng phòng trực tiếp nhận chỉ đạo và nội dung công tác từ Chủ tịch hoặc Phó Chủ tịch phụ trách khối và phải thường xuyên báo cáo với Thường trực Ủy ban nhân dân Quận 8 về những mặt công tác đã được phân công;

- Theo định kỳ phải báo cáo với Thường trực Ủy ban nhân dân Quận 8 về nội dung công tác của Phòng và đề xuất các biện pháp giải quyết công tác chuyên môn trong quản lý nhà nước thuộc lĩnh vực liên quan.

2. Đối với các Sở - ngành liên quan:

Phòng Kinh tế chịu sự hướng dẫn và kiểm tra về chuyên môn, nghiệp vụ của các Sở - ngành liên quan đến chức năng, nhiệm vụ của Phòng, thực hiện việc báo cáo công tác chuyên môn định kỳ và theo yêu cầu của Giám đốc các Sở liên quan.

3. Đối với các cơ quan chuyên môn khác thuộc Ủy ban nhân dân Quận 8:

Thực hiện mối quan hệ hợp tác và phối hợp trên cơ sở bình đẳng, theo chức năng, nhiệm vụ, dưới sự điều hành chung của Ủy ban nhân dân Quận 8, nhằm đảm bảo hoàn thành kế hoạch, nhiệm vụ chính trị của Quận 8. Trường hợp chủ trì phối hợp giải quyết công việc, nếu chưa nhất trí với ý kiến của Trưởng các Phòng chuyên môn khác, Trưởng Phòng Kinh tế chủ động tập hợp các ý kiến và trình Chủ tịch Ủy ban nhân dân Quận 8 xem xét, quyết định.

4. Đối với Ủy ban nhân dân các phường:

a) Phối hợp hỗ trợ và tạo điều kiện để Ủy ban nhân dân các phường thực hiện các nội dung quản lý nhà nước liên quan đến chức năng, nhiệm vụ của Phòng;

b) Hướng dẫn, kiểm tra cán bộ các phường về chuyên môn, nghiệp vụ của ngành, lĩnh vực công tác do Phòng quản lý;

c) Tổ chức giao ban với Ủy ban nhân dân phường về lĩnh vực Phòng phụ trách.

5. Đối với Ủy ban Mặt trận Tổ quốc Việt Nam Quận 8, các đơn vị sự nghiệp, các ban, ngành, đoàn thể, các tổ chức xã hội của Quận 8:

Khi Ủy ban Mặt trận Tổ quốc Việt Nam Quận 8, phường, các đơn vị sự nghiệp, các ban, ngành, đoàn thể, các tổ chức xã hội của Quận 8 có yêu cầu, kiến nghị các vấn đề thuộc chức năng của Phòng, Trưởng phòng có trách nhiệm trình bày, giải quyết hoặc trình Ủy ban nhân dân Quận 8 giải quyết các yêu cầu đó theo thẩm quyền.

Chương V

ĐIỀU KHOẢN THI HÀNH

Điều 9. Căn cứ Quy chế này, Trưởng Phòng Kinh tế Quận 8 có trách nhiệm cụ thể hóa chức năng, nhiệm vụ của Phòng, quyền hạn, trách nhiệm, chức danh, tiêu chuẩn công chức của Phòng phù hợp với đặc điểm của địa phương, nhưng không trái với nội dung Quy chế này, trình Chủ tịch Ủy ban nhân dân Quận 8 quyết định để thi hành.

Điều 10.Trưởng Phòng Kinh tế Quận 8 và Thủ trưởng các cơ quan, đơn vị liên quan có trách nhiệm thực hiện Quy chế tổ chức và hoạt động của Phòng Kinh tế sau khi được Ủy ban nhân dân Quận 8 quyết định ban hành. Trong quá trình thực hiện nếu phát sinh các vấn đề vượt quá thẩm quyền thì nghiên cứu đề xuất, kiến nghị với

Ủy ban nhân dân Quận 8 xem xét, giải quyết hoặc bổ sung và sửa đổi Quy chế cho phù hợp sau khi có sự thỏa thuận của Trưởng Phòng Nội vụ Quận 8./.

ORGANIZATION AND OPERATION OF DIVISION OF ECONOMIC OF DISTRICT 8

CHAPTER I

LOCATION AND FUNCTION

Article 1. Location and function

1. Location:

Economic Division of District 8 is a specialized agency under the People's Committee of District 8; under the direct and comprehensive direction and management of the organization, staff and work of the People's Committee of District 8; at the same time subject to the professional guidance and inspection of the Department of Agriculture and Rural Development, the Department of Industry and Trade, the Department of Science and Technology, and the Department of Planning and Investment.

Economic Division of District 8 has legal status, its own seal and account.

2. Function:

The Economic Division of District 8 has the function of advising and assisting the People's Committee of District 8 in performing State  management in the following fields: handicrafts; science and technology; industry; commerce; service; energy management; Business Registration; synthesize and unify the management of the cooperative economy, the collective economy and the private economy; market, State management of electricity.

CHAPTER II

DUTIES AND POWERS

Article 2. Duties and powers

The Economic Division of District 8 has these following duties and powers:

1. General duties and powers in the fields of State management are assigned:

a) To submit to the People's Committee of District 8 draft decisions and directives; planning, long-term, 5-year and annual plans on the development of branches in District 8 according to the functions and duties of the Division; programs and measures to organize the implementation of State administrative reform tasks and decentralize management in the assigned fields in the locality. Annual State budget estimates for assigned State management domains;

b) To organize the implementation of legal documents, plannings, plans and duties of administrative reform in the assigned fields after they are promulgated and approved; to inform, propagate, educate, disseminate and guide legal documents, mechanisms, policies, expertise and operations in the fields under their assigned management;

c) To assist the People's Committee of District 8 in State management to the activities of all economic sectors in District 8 within the scope of assigned economic sectors; guide and inspect the activities of associations and non-governmental organizations in the area under their assigned State management;

d) To provide professional guidance on the assigned field to ward officials and civil servants in District 8;

đ) To assist the People's Committee of District 8 in implementing and taking responsibility for the appraisal, registration, granting and revocation of business registration certificates and licenses within the scope of responsibility and authority of the Division in accordance with regulations of  law and as assigned by the People's Committee of District 8;

e) To have the right to request agencies and units of District 8 and the People's Committee of the ward to provide data related to the field of management under the functions and duties of the Division; carry out the work of information, periodical and irregular reports related to the functions and duties assigned by the Division in accordance with the provisions of the People's Committee of District 8 and relevant Departments and branches;

g) To assume the prime responsibility for, and coordinate with relevant agencies in  checking and inspecting and proposing handling of violations against organizations and individuals in the observance of the law in their assigned fields in the locality; resolve the complaint report; preventing and combating corruption and waste in the activities of the assigned fields in the locality according to the provisions of law and the decentralization of the People's Committee of District 8;

h) To organize the implementation and application of scientific and technological advances; to support collective economic organizations and private businesses located in the locality in the implementation and application of scientific and technological advances; build an information and archiving system in service of State management and the Department's expertise;

i) To manage finances and assets of the Division in accordance with the law and decentralized by the People's Committee of District 8;

k) To monitor, synthesize and report periodically every 6 months, 1 year and irregularly on the performance of assigned tasks to the People's Committee of District 8, the Department of Industry and Trade, the Department of Science and Technology, the Department of Planning and Investment, Department of Agriculture and Rural Development and other competent agencies as prescribed by law.

2. Specific duties and powers of collective and private economy:

a) To assist the People's Committee of District 8 in implementing and take responsibility for the appraisal, registration, grant and revocation of business registration certificates and licenses as assigned by the People's Committee of District 8; carry out and be responsible for the appraisal of registration, grant and revocation of licenses for retail business (or retail agent) of tobacco, production and trading of alcohol within the scope of responsibility and authority of the Division according to the provisions of law;

b) To organize, guide and implement policies to encourage organizations of collective economic and private economic to invest in developing production and business activities; organize consulting services on technology transfer, information provision, trade promotion and human resource training for production and business establishments in the locality;

c) To synthesize, monitor and evaluate the implementation of programs, plans, mechanisms and policies for the development of the collective economy, the private economy, and the operation of organizations of collective economic and  private economy in District 8.

3. Specific duties and powers in science - technology and energy:

a) To submit to the Chairman of the People's Committee of District 8 for decision on the establishment of the Science and Technology Council in accordance with the provisions of the Law on Science and Technology, the guidance of the Ministry of Science and Technology and serving as a permanent member of the Science and Technology Council of the People's Committee of District 8;

b) To develop a creative labor movement, popularize and select scientific and technological advances, results of scientific research and technological development, inventions, innovations, technical improvements, rationalize production to support application at agencies, organizations and enterprises in District 8; organize the implementation of science and technology services in the locality. Monitor, supervise, coordinate and support the implementation of technology transfer projects into production and life in the locality;

c) State management over activities of standards, measurement, quality, intellectual property, application of radiation and radioisotopes; radiation and nuclear safety as prescribed by law and under the guidance of the Department of Science and Technology;

d) To build a system of information, statistics and archiving on science and technology in the locality under the guidance of the Department of Science and Technology;

đ) To implement the planning, policies and plans for electricity development, develop the application of new energy, solar energy, wind energy and other forms of energy in the locality under their management;

e) To implement planning, plan about research and development of production and economical and efficient use of energy in the locality under management;

g) To organize the implementation of regulations on management of electricity activities in the locality; regulations on safety corridors for high-voltage power grids and other electrical works in the locality under their management;

h) To organize training on legal knowledge on electricity activities and electricity use, training on economical, efficient and safe use of energy for energy managers, officials and employees of the enterprises, production facilities and electricity management organizations in the locality; guide and inspect the application of electrical safety standards, regulations and rules in economical and efficient use of energy, electricity activities and electricity use, procedures and regulations on voltage safety used within agencies and enterprises;

i) To organize the implementation of the electricity price plan in the locality under management. Coordinate with competent State agencies in conducting specialized electricity inspection and testing according to the provisions of law and handling violations of the law in the field of energy.

4. Specific duties and powers regarding agriculture and rural development:

a) To coordinate with the works in the prevention, combat and overcoming of consequences of natural disasters, pests and diseases in the locality;

b) To coordinate with relevant agencies to organize the protection of flood and storm prevention works;

c) To implement measures for economic restructuring;

d) To summarize the situation and report to the People's Committee of the district on the construction and development of cooperative economy and cooperatives;

5. To implement some other duties:

a) To advise the People's Committee of District 8 to develop and organize the implementation of the planning for the development of markets, supermarkets, trade centers and commercial stores in the area of ​​District 8; Assist the People's Committee of District 8 in performing the State management of markets, supermarkets, commercial centers, and commercial stores in District 8;

b) To coordinate with the Division of Home Affairs to advise and propose the People's Committee of District 8 on personnel work of the Market Management Board in the area of ​​District 8.

c) To perform a number of other duties in the fields of State management in the branch as assigned, decentralized or authorized by the People's Committee of District 8 and according to the provisions of law.

CHAPTER III

ORGANIZATION OF APPARATUS AND STAFF

Article 3. Organization of apparatus

1. The Economic Division of District 8 has a Chief and no more than 03 Deputy Chiefs.

a) The Chief of the Division is responsible to the People's Committee, the Chairman of the People's Committee and before the law for all activities of the Division, and at the same time is responsible to the Directors of the Departments related to the fields of performing professional work of Division.

b) The Deputy Chiefs of the Division are the ones who help the Chief of the Division, take responsibility before the Chief and before the law for the tasks assigned; In the absence of the Chief of the Division, a Deputy Chief of the Division is authorized to manage the activities of the Division.

c) The appointment of the Chief and Deputy Chief of the Division is decided by the Chairman of the People's Committee of District 8 according to professional standards; The dismissal, commendation and discipline of the Chief and Deputy Chiefs of the Division shall comply with the provisions of law.

d) Cadres and professional cadres and civil servants in charge are arranged commensurate with their assigned tasks.

2. The Economic Division of District 8 is organized into 5 Working teams, including civil servants who are assigned to take on the following job titles on the working aspects of the Division:

- Management team of markets, supermarkets and trade centers;

- Business Registration Management Team;

- Science, Technology and Energy Management Team;

- Management team of cooperative economy, collective economy, private economy.

- Management Team of Industry, Trade and Service;

- Administrative team to manage, handle complaints and denunciations.

Article 4. Staff

Based on the workload and specific staff situation to determine each title and professional standards of civil servants to allocate staff appropriately, ensure the performance and completion of assigned tasks.

The specific number of staff for the branch management of the Economic Division shall be decided by the Chairman of the District 8 People's Committee in the total administrative payroll of District 8 on the basis of the administrative staffing quota set by the People's Committee of city assigns District 8 annually.

Cadres and civil servants of the Economic Division of District 8 have specific titles and duties, have nameplates placed at the workplace, and wear official identification cards as prescribed. Cadres and civil servants must have a polite, dedicated, humble, respectful attitude and working style, and listen to the opinions of the leaders of the Division, colleagues and organizations or individuals who come to work.

CHAPTER IV

WORKING MODE AND WORKING RELATIONSHIP

Article 5. Working mode

1.               The Chief of the Division is in charge of general management of the Division's activities and is in charge of key tasks. The Deputy Chiefs of the Division are in charge of the areas of work assigned by the Chief of the Division;

2.               When dealing with work in the field under his/her responsibility related to the professional contents of other Deputy Chiefs, the Deputy Chiefs of the Division actively discuss and agree on a solution, only submitting to the Chief of Division for decision the issues that have not been agreed upon with other Deputy Chiefs or new problems arise without guidelines, plans and solutions.

3.               In case the Chief of the Division directly requests the officers and experts to handle the work within the competence of the Deputy Chief of the Division, such request shall be fulfilled but the officer must report to the Deputy Chief of the Division directly in charge of the matter.

Article 6. Meeting mode

1. Every week, the leader of the Division holds a briefing once to evaluate the performance of the duties and disseminate the work plan for the following week.

2. After handing over the leadership of the Division, parts will meet with the Deputy Chief of the Division directly in charge to evaluate the work, discuss the direction of work implementation and agree on the working schedule.

3. The whole agency meets once a month.

4. Each member in each part has a working schedule approved by the Division's leader directly.

5. The working schedule with the Division's facilities (related organizations and individuals) must be specified in the weekly and monthly working schedule of the unit; Working content is carefully prepared by the Division to promptly and effectively deal with arising requests related to the Division's professional activities.

6. The Economic Division may hold unscheduled meetings to carry out necessary and urgent work at the request of the People's Committee of District 8 or leaders of relevant city departments and agencies.

Article 7. Report information mode

Periodically (or irregularly), relevant units are responsible for reporting on their operations, statistics and data related to their respective fields to the Division of Economic for the purpose of serving the needs of compiling reports or consulting reports according to regulations.

Article 8. Working relationship

1. For People’s Committee of District 8:

- The Division of Economic is under the direct and comprehensive leadership and direction of the People's Committee of District 8 for all work according to the functions and duties of the Division, the Chief of the Division directly receives instructions and work contents from the Chairman or Vice Chairman is in charge of the division and must regularly report to the Standing Committee of the District 8 People's Committee on the assigned tasks;

- To periodically report to the Standing Committee of the District 8 People's Committee on the contents of the Division's work and propose measures to solve professional work in State management in the relevant fields.

2. For related departments and branches:

The Division of Economic is subject to the professional guidance and examination of the Departments and branches related to the functions and dutiesof the Division, and periodically reports on professional work and at the request of the Director of relevant departments.

3. For other specialized agencies under the People's Committee of District 8:

To implement cooperation and coordination relationships on an equal basis, according to functions and duties, under the general management of the People's Committee of District 8, in order to ensure the completion of the political plans and duties of District 8. In case of coordinating to solve the work, if not agreeing with the opinions of the Heads of other specialized divisions, the Chief of the Economic Division actively gathers opinions and submits them to the Chairman of the District 8 People's Committee for consideration and decision.

4. For People’s Committee of wards:

a) To coordinate to support and create conditions for the People's Committees of wards to carry out State management contents related to the functions and duties of the Division;

b) To guide and inspect ward officials on the professional skills of the branches and fields of work managed by the Division;

c) To organize meetings with the People's Committee of the ward on the area in charge of the Division.

5. For the Vietnam Fatherland Front Committee of District 8, the non-business units, departments, branches, mass organizations, social organizations of District 8:

When the Vietnam Fatherland Front Committee of District 8, wards, non-business units, departments, branches, mass organizations and social organizations of District 8 have requests and recommendations on matters falling within the functions of the Division. , the Chief of the Division  is responsible for presenting, settling or submitting to the People's Committee of District 8 for settlement of such requests according to his/her competence.

CHAPTER V

ENFORCEMENT PROVISIONS

Article 9. Pursuant to this Regulation, the Chief of the Division of Ecnonic of District 8 is responsible for specifying the functions and duties of the division, powers, responsibilities, titles and civil servants standards of the division in accordance with the characteristics of the locality, but not contrary to the content of this Regulation, submit it to the Chairman of the People's Committee of District 8 for decision to implement.

Article 10. The Chief of the Division of Economic of District 8 is responsible for implementing the Regulation on organization and operation of the Division of Economic after decided by the People’s Committee of District 8. In the course of implementation, if problems arise beyond its competence, the division researchs to propose their request to the Chairman of the People's Committee of District 8 to consider, resolve or supply and amend the Regulation accordingly after having the agreement of the Chief of the Division of Home Affairs of District 8./.
