Quy chế tổ chức và hoạt động của Phòng Tài nguyên và Môi trường Quận 8

Chương I

 QUY ĐỊNH CHUNG

Điều 1. Vị trí và chức năng

1. Vị trí

Phòng Tài nguyên và Môi trường Quận 8 là cơ quan chuyên môn thuộc Ủy ban nhân dân Quận 8.

Phòng Tài nguyên và Môi trường Quận 8 có tư cách pháp nhân, có con dấu và tài khoản riêng; chịu sự chỉ đạo, quản lý và điều hành của Ủy ban nhân dân Quận 8; đồng thời, chịu sự chỉ đạo, kiểm tra, hướng dẫn về chuyên môn, nghiệp vụ của Sở Tài nguyên và Môi trường Thành phố Hồ Chí Minh.

2. Chức năng

Phòng Tài nguyên và Môi trường Quận 8 thực hiện chức năng tham mưu, giúp Ủy ban nhân dân Quận 8 quản lý nhà nước về tài nguyên và môi trường, gồm: đất đai, tài nguyên nước, khoáng sản, môi trường, biến đổi khí hậu.

Điều 2. Nhiệm vụ và quyền hạn

Phòng Tài nguyên và Môi trường Quận 8 có nhiệm vụ và quyền hạn sau đây:

1. Trình Ủy ban nhân dân Quận 8 ban hành quyết định, chỉ thị; quy hoạch, kế hoạch dài hạn, 05 năm và hàng năm; chương trình, biện pháp tổ chức thực hiện các nhiệm vụ cải cách hành chính nhà nước thuộc lĩnh vực tài nguyên và môi trường.

2. Tổ chức thực hiện các văn bản pháp luật, quy hoạch, kế hoạch sau khi được phê duyệt; thông tin, tuyên truyền, phổ biến, giáo dục pháp luật về tài nguyên và môi trường; theo dõi thi hành pháp luật về tài nguyên và môi trường.

3.Trình Ủy ban nhân dân Quận 8 ban hành các văn bản hướng dẫn việc thực hiện các quy hoạch, kế hoạch, chính sách, pháp luật của Nhà nước về quản lý tài nguyên và môi trường; kiểm tra việc thực hiện sau khi Ủy ban nhân dân Quận 8 ban hành.

4. Lập quy hoạch, kế hoạch sử dụng đất, điều chỉnh quy hoạch, kế hoạch sử dụng đất trên địa bàn quận và tổ chức thực hiện sau khi được phê duyệt. Thực hiện việc lưu trữ 01 bộ hồ sơ quy hoạch, kế hoạch sử dụng đất trên địa bàn quận theo đúng quy định.

5. Xác định các chỉ tiêu sử dụng đất thành phố và các dự án trong quy hoạch, kế hoạch sử dụng đất Thành phố đã phân bổ cho quận đến từng phường; tổng hợp, cân đối nhu cầu sử dụng đất và dự kiến phân bổ các chỉ tiêu sử dụng đất của quận đến từng phường.

6. Thẩm định hồ sơ về giao đất, cho thuê đất, thu hồi đất, chuyển mục đích sử dụng đất, cấp giấy chứng nhận quyền sử dụng đất, quyền sở hữu nhà ở và tài sản khác gắn liền với đất cho các đối tượng thuộc thẩm quyền của Uỷ ban nhân dân Quận 8.

7. Giúp Ủy ban nhân dân Quận 8 thực hiện công tác thống kê, kiểm kê đất đai, lập bản đồ hiện trạng sử dụng đất.

8. Theo dõi biến động về đất đai; thực hiện việc lập, quản lý, cập nhật và chỉnh lý hồ sơ địa chính, xây dựng hệ thống thông tin đất đai cấp quận.

9. Đối với trường hợp tranh chấp đất đai giữa hộ gia đình, cá nhân, cộng đồng dân cư với nhau, sau khi hòa giải thành mà có thay đổi hiện trạng về ranh giới, người sử dụng đất thì Phòng Tài nguyên và Môi trường căn cứ biên bản hoà giải của Ủy ban nhân dân phường trình Ủy ban nhân dân Quận 8 quyết định công nhận việc thay đổi ranh giới thửa đất và giấy chứng nhận quyền sử dụng đất, quyền sở hữu nhà ở và tài sản khác gắn liền với đất.

10. Tham gia, phối hợp với các cơ quan có liên quan trong việc xác định giá đất, mức thu tiền sử dụng đất, tiền thuê đất của địa phương; tham mưu cho Ủy ban nhân dân Quận 8 trong công tác thu hồi đất; chủ trì, phối hợp các cơ quan có liên quan thực hiện thẩm định phương án bồi thường, hỗ trợ, tái định cư trước khi trình Ủy ban nhân dân Quận 8 phê duyệt; giúp Chủ tịch Ủy ban nhân dân Quận 8 quyết định trưng dụng đất, gia hạn trưng dụng đất.

11. Tổ chức đăng ký, xác nhận và kiểm tra việc thực hiện cam kết bảo vệ môi trường, đề án bảo vệ môi trường đơn giản, kế hoạch bảo vệ môi trường và các kế hoạch phòng ngừa, ứng phó và khắc phục sự cố môi trường trên địa bàn; thực hiện công tác bảo vệ môi trường trên địa bàn; lập báo cáo hiện trạng môi trường theo định kỳ; đề xuất các giải pháp xử lý ô nhiễm môi trường, các cụm công nghiệp, khu du lịch trên địa bàn; thu thập, quản lý lưu trữ dữ liệu về tài nguyên nước, môi trường và đa dạng sinh học trên địa bàn.

12. Tham gia thực hiện các giải pháp ngăn ngừa và kiểm soát các loài sinh vật ngoại lai xâm hại; tiếp nhận, xử lý thông tin, dữ liệu về các sinh vật biến đổi gen và sản phẩm, hàng hoá có nguồn gốc từ sinh vật biến đổi gen, quản lý nguồn gen; tham gia tổ chức thực hiện các kế hoạch, chương trình bảo tồn và phát triển bền vững các hệ sinh thái, loài và nguồn gen.

13. Thực hiện các biện pháp bảo vệ chất lượng tài nguyên nước, nguồn nước sinh hoạt tại địa phương.

14. Điều tra, thống kê, tổng hợp và phân loại giếng phải trám lấp; kiểm tra, giám sát việc thực hiện trình tự, thủ tục, yêu cầu kỹ thuật trong việc trám lấp giếng theo quy định.

15. Tổ chức ứng phó, khắc phục sự cố ô nhiễm nguồn nước; theo dõi, phát hiện và tham gia giải quyết sự cố ô nhiễm nguồn nước theo thẩm quyền.

16. Tổ chức đăng ký hoạt động khai thác, sử dụng tài nguyên nước, xả nước thải vào nguồn nước theo thẩm quyền.

17. Giúp Ủy ban nhân dân Quận 8 giải quyết theo thẩm quyền cho thuê đất hoạt động khoáng sản, sử dụng hạ tầng kỹ thuật và các vấn đề khác có liên quan cho tổ chức, cá nhân được phép hoạt động khoáng sản tại địa phương theo quy định của pháp luật.

18. Giúp Ủy ban nhân dân Quận 8 thực hiện các biện pháp bảo vệ khoáng sản chưa khai thác, tài nguyên thiên nhiên khác theo quy định của pháp luật.

19. Tổ chức thực hiện kế hoạch hành động ứng phó với biến đổi khí hậu và tham gia cập nhật kế hoạch hành động ứng phó với biến đổi khí hậu trên địa bàn Quận 8.

20. Tổ chức thực hiện các quy định của pháp luật về bảo vệ môi trường, tài nguyên đất, tài nguyên nước, tài nguyên khoáng sản.

21. Theo dõi, kiểm tra các tổ chức, cá nhân trong việc thực hiện các quy định của pháp luật về tài nguyên và môi trường; giải quyết khiếu nại, tố cáo; phòng, chống tham nhũng, lãng phí về tài nguyên và môi trường theo quy định của pháp luật và phân công của Ủy ban nhân dân Quận 8.

22. Ứng dụng tiến bộ khoa học, công nghệ; xây dựng hệ thống thông tin, lưu trữ và thực hiện các dịch vụ công, dịch vụ công trực tuyến phục vụ công tác quản lý nhà nước về tài nguyên và môi trường.

23. Giúp Ủy ban nhân dân Quận 8 quản lý nhà nước đối với các tổ chức kinh tế tập thể, kinh tế tư nhân trong lĩnh vực tài nguyên và môi trường; tham gia quản lý tổ chức và hoạt động của các hội và tổ chức phi chính phủ trong lĩnh vực tài nguyên và môi trường thuộc thẩm quyền Ủy ban nhân dân Quận 8.

24. Hướng dẫn, kiểm tra chuyên môn, nghiệp vụ quản lý nhà nước về tài nguyên và môi trường đối với công chức chuyên môn về tài nguyên và môi trường thuộc Ủy ban nhân dân 16 phường Quận 8; hướng dẫn Ủy ban nhân dân 16 phường quy định về tổ chức, hoạt động và tạo điều kiện để tổ chức tự quản về bảo vệ môi trường hoạt động có hiệu quả.

25. Thực hiện công tác thông tin, báo cáo định kỳ và đột xuất về tình hình thực hiện nhiệm vụ được giao theo quy định của Ủy ban nhân dân Quận 8 và Sở Tài nguyên và Môi trường Thành phố Hồ Chí Minh.

26. Quản lý tổ chức bộ máy, vị trí việc làm, biên chế công chức, cơ cấu ngạch công chức, thực hiện chế độ tiền lương, chính sách, chế độ đãi ngộ, khen thưởng, kỷ luật, đào tạo và bồi dưỡng về chuyên môn, nghiệp vụ đối với công chức và người lao động thuộc phạm vi quản lý của Phòng Tài nguyên và Môi trường theo quy định của pháp luật và phân công của Ủy ban nhân dân Quận 8.

27. Quản lý và chịu trách nhiệm về tài chính, tài sản của Phòng Tài nguyên và Môi trường theo quy định của pháp luật.

28. Giúp Ủy ban nhân dân Quận 8 quản lý các nguồn tài chính và các dịch vụ công trong lĩnh vực tài nguyên và môi trường theo quy định của pháp luật.

29. Thực hiện các nhiệm vụ khác do Ủy ban nhân dân Quận 8 theo quy định của pháp luật.

Chương II

TỔ CHỨC BỘ MÁY VÀ BIÊN CHẾ

Điều 3. Tổ chức bộ máy

Phòng Tài nguyên và Môi trường Quận 8 có Trưởng phòng và không quá 02 Phó Trưởng phòng và các công chức chuyên môn nghiệp vụ.

a) Trưởng Phòng Tài nguyên và Môi trường chịu trách nhiệm trước Ủy ban nhân dân Quận 8, Chủ tịch Ủy ban nhân dân Quận 8, đồng thời chịu trách nhiệm trước Giám đốc Sở Tài nguyên và Môi trường về thực hiện các mặt công tác chuyên môn và trước pháp luật về việc thực hiện chức năng, nhiệm vụ, quyền hạn được giao và toàn bộ hoạt động của Phòng.

b) Phó Trưởng phòng giúp Trưởng phòng phụ trách và theo dõi một số mặt công tác; chịu trách nhiệm trước Trưởng phòng và theo quy định của pháp luật về nhiệm vụ được phân công.

Khi Trưởng phòng vắng mặt, một Phó Trưởng phòng được Trưởng phòng ủy quyền điều hành các hoạt động của Phòng.

c) Việc bổ nhiệm Trưởng phòng và Phó Trưởng phòng do Chủ tịch Ủy ban nhân dân Quận 8 quyết định theo tiêu chuẩn chức danh do Sở Tài nguyên và Môi trường trình Ủy ban nhân dân thành phố ban hành và theo quy định của pháp luật.

Việc miễn nhiệm, cách chức, khen thưởng, kỷ luật và các chế độ, chính sách khác đối với Trưởng phòng và các Phó Trưởng phòng thực hiện theo quy định của pháp luật.

Điều 4. Biên chế

Biên chế công chức của Phòng Tài nguyên và Môi trường do Chủ tịch Ủy ban nhân dân Quận 8 quyết định trên cơ sở vị trí việc làm, gắn với chức năng, nhiệm vụ, phạm vi hoạt động và nằm trong tổng biên chế công chức trong các cơ quan, tổ chức hành chính được Ủy ban nhân dân thành phố giao cho Quận 8 hàng năm.

Căn cứ chức năng, nhiệm vụ, danh mục vị trí việc làm, cơ cấu ngạch công chức được cấp có thẩm quyền phê duyệt, hàng năm Phòng Tài nguyên và Môi trường xây dựng kế hoạch biên chế công chức theo quy định của pháp luật bảo đảm thực hiện nhiệm vụ được giao.

Chương III

CHẾ ĐỘ LÀM VIỆC VÀ QUAN HỆ CÔNG TÁC

Điều 5. Chế độ làm việc

1. Phòng Tài nguyên và Môi trường làm việc theo chế độ thủ trưởng. Trưởng phòng phụ trách, điều hành toàn bộ các hoạt động của Phòng và phụ trách những công tác trọng tâm. Các Phó Trưởng phòng phụ trách những lĩnh vực công tác được Trưởng phòng phân công, trực tiếp giải quyết các công việc phát sinh.

2. Khi giải quyết công việc thuộc lĩnh vực mình phụ trách có liên quan đến nội dung chuyên môn của Phó Trưởng phòng khác; Phó Trưởng phòng chủ động bàn bạc thống nhất hướng giải quyết, chỉ định Trưởng phòng quyết định các vấn đề chưa nhất trí với Phó Trưởng phòng khác hoặc những vấn đề mới phát sinh mà chưa có chủ trương, kế hoạch và biện pháp giải quyết.

3. Trong trường hợp Trưởng phòng trực tiếp yêu cầu các cán bộ, chuyên viên giải quyết công việc thuộc phạm vi thẩm quyền của Phó Trưởng phòng, yêu cầu đó được thực hiện nhưng cán bộ phải báo cáo cho Phó Trưởng phòng trực tiếp phụ trách biết.

Điều 6. Chế độ sinh hoạt hội họp

1. Hàng tuần, lãnh đạo phòng họp giao ban một lần để đánh giá việc thực hiện nhiệm vụ và phổ biến kế hoạch công tác cho tuần sau.

2. Sau khi giao ban lãnh đạo Phòng, các Tổ trưởng, Tổ phó bộ phận họp với Trưởng phòng hoặc Phó Trưởng phòng trực tiếp phụ trách để đánh giá công việc, bàn phương hướng triển khai công tác và thống nhất lịch công tác.

3. Căn cứ vào chương trình công tác hàng năm, hàng tháng của Ủy ban nhân  dân Quận 8 và yêu cầu giải quyết công việc, Trưởng phòng tổ chức hợp toàn thể cán bộ công chức một lần trong tháng.

Các cuộc họp bất thường trong tháng chỉ được tổ chức để giải quyết công việc đột xuất, khẩn cấp.

4. Mỗi thành viên trong từng bộ phận có lịch công tác do lãnh đạo Phòng trực tiếp phê duyệt.

5. Lịch làm việc với các tổ chức và cá nhân có liên quan, thể hiện trong lịch công tác hàng tuần, hàng tháng của đơn vị; nội dung làm việc được Phòng chuẩn bị chu đáo để giải quyết có hiệu quả các yêu cầu phát sinh liên quan đến hoạt động chuyên môn của Phòng.

Điều 7. Mối quan hệ công tác

1.     Đối với Sở Tài nguyên và Môi trường và các cơ quan có liên quan:

Phòng Tài nguyên và Môi trường chịu sự hướng dẫn, kiểm tra về chuyên môn, nghiệp vụ của Sở Tài nguyên và Môi trường, thực hiện việc báo cáo công tác chuyên môn định kỳ và theo yêu cầu của Giám đốc Sở Tài nguyên và Môi trường;

Cử cán bộ phối hợp với các cơ quan có liên quan thực hiện thanh tra, kiểm tra trong lĩnh vực tài nguyên và môi trường tại Quận 8 khi có yêu cầu:

2. Đối với Ủy ban nhân dân Quận 8:

Phòng Tài nguyên và Môi trường chịu sự lãnh đạo, chỉ đạo trực tiếp và toàn diện của Ủy ban nhân dân Quận 8 về toàn bộ công tác theo chức năng, nhiệm vụ của Phòng, Trưởng phòng trực tiếp nhận chỉ đạo và nội dung công tác từ Chủ tịch hoặc Phó Chủ tịch phụ trách khối và phải thường xuyên báo cáo với Thường trực Ủy ban nhân dân Quận 8 về những mặt công tác đã được phân công;

Theo định kỳ phải báo cáo với Ủy ban nhân dân Quận 8 về nội dung công tác của Phòng và đề xuất các biện pháp giải quyết công tác chuyên môn trong quản lý nhà nước thuộc lĩnh vực liên quan.

3. Đối với Văn phòng Đăng ký đất đai Thành phố Hồ Chí Minh, Chi nhanh Văn phòng Đăng ký đất đai Quận 8:

- Bảo đảm thực hiện, phối hợp đồng bộ, thống nhất, chặt chẽ, kịp thời, công khai, minh bạch, đúng quy định theo pháp luật và các văn bản hướng dẫn có liên quan.

- Xác định rõ cơ quan, đơn vị chủ trì, phối hợp; trách nhiệm, quyền hạn của người đứng đầu cơ quan, đơn vị; nội dung, thời hạn, cách thức thực hiện; chế độ thông tin, bảo cáo.

- Tuân thủ các quy định của pháp luật hiện hành; phù hợp với chức năng, nhiệm vụ, quyền hạn, quy chế tổ chức hoạt động của từng cơ quan, đơn vị.

4. Đối với các cơ quan chuyên môn khác thuộc Ủy ban nhân dân Quận 8

Thực hiện mối quan hệ hợp tác và phối hợp trên cơ sở bình đẳng, theo chức năng, nhiệm vụ, dưới sự điều hành chung của Ủy ban nhân dân Quận 8, nhằm đàm bảo hoàn thành nhiệm vụ chính trị, kế hoạch kinh tế - xã hội của Quận 8. Trong trường hợp Phòng Tài nguyên và Môi trường chủ trì phối hợp giải quyết công việc, nếu chưa nhất trí với ý kiến của Thủ trưởng các cơ quan chuyên môn khác, Trưởng Phòng Tài nguyên và Môi trường tập hợp các ý kiến và trình Chủ tịch Ủy ban nhân dân Quận 8 xem xét, quyết định.

5. Đối với Ủy ban Mặt trận Tổ quốc Việt Nam Quận 8, các đơn vị sự nghiệp, các ban, ngành, đoàn thể, các tổ chức xã hội của Quận 8:

Khi Ủy ban Mặt trận Tổ quốc Việt Nam Quận 8, các đơn vị sự nghiệp, các ban, ngành, đoàn thể, các tổ chức xã hội của Quận 8 có yêu cầu, kiến nghị các vấn đề thuộc chức năng của Phòng, Trưởng phòng có trách nhiệm trình bày, giải quyết hoặc trình Ủy ban nhân dân Quận 8 giải quyết các yêu cầu đó theo thẩm quyền. Đồng thời phối hợp tổ chức các hoạt động tuyền truyền về biến đổi khí hậu và bảo vệ môi trường theo kế hoạch hàng năm.

6. Đối với Ủy ban nhân dân 16 phường:

a) Phối hợp hỗ trợ và tạo điều kiện để Ủy ban nhân dân các phường thực hiện các nội dung quản lý nhà nước liên quan đến chức năng, nhiệm vụ của Phòng.

b) Hướng dẫn cán bộ, công chức Ủy ban nhân dân 16 phường về chuyên môn, nghiệp vụ của ngành, lĩnh vực công tác do Phòng quản lý,

Chương IV

 ĐIỀU KHOẢN THI HÀNH

Điều 8. Căn cứ Quy chế này, Trưởng Phòng Tài nguyên và Môi trường      Quận 8 có trách nhiệm cụ thể hóa chức năng, nhiệm vụ của Phòng; quyền hạn, trách nhiệm, chức danh, tiêu chuẩn công chức của Phòng phù hợp với đặc điểm của địa phương nhưng không trái với nội dung Quy chế này, trình Ủy ban nhân dân Quận 8 quyết định để thi hành.

Điều 9. Trưởng Phòng Tài nguyên và Môi trường và Thủ trưởng các cơ quan, đơn vị liên quan và Chủ tịch Ủy ban nhân dân 16 phường Quận 8 có trách nhiệm thực hiện Quy chế tổ chức và hoạt động của Phòng Tài nguyên và Môi trường sau khi được Ủy ban nhân dân Quận 8 quyết định ban hành. Trong quá trình thực hiện, nếu phát sinh các vấn đề vượt quá thẩm quyền thì nghiên cứu đề xuất, kiến nghị với Ủy ban nhân dân Quận 8 xem xét, giải quyết hoặc bổ sung và sửa đổi Quy chế cho phù hợp./.

Regulations on organization and operation of Division of Natural Resources and Environment of District 8

CHAPTER I

 GENERAL REGULATIONS

Article 1. Location and function

1. Location

Division of  Natural Resources and Environment of District 8 is a specialized agency under the People's Committee of District 8.

Division of  Natural Resources and Environment of District 8 has legal status, its own seal and account; under the direction, management and administration of the People's Committee of  District 8; at the same time, subject to the direction, inspection and professional guidance of the Department of Natural Resources and Environment of Ho Chi Minh City.

2. Function

Division of Natural Resources and Environment of District 8 performs the function of advising and assisting the People's Committee of District 8 in State management of natural resources and environment, including: land, water resources, minerals, environment, and climate change.

Article 2. Duties and powers

Division of Natural Resources and Environment of District 8 has the duties and powers as follows:

1.                   To submit to the People's Committee of District 8 for issuance of decisions and directives; planning, long-term, 5-year and annual plans; programs and measures to organize the implementation of State administrative reform tasks in the field of natural resources and environment.

2.                   To organize the implementation of legal documents, master plans and plans after they are approved; information, propaganda, dissemination and education of the law on natural resources and environment; monitor the enforcement of laws on natural resources and environment.

3.                   To submit to the People's Committee of District 8 for promulgation documents guiding the implementation of the State's master plans, plans, policies and laws on management of natural resources and environment; check the implementation after the People's Committee of District 8 promulgated.

4.                   To formulate master plans and plans on land use, adjust master plans and plans on land use in the district and organize the implementation after they are approved. Store 01 set of documents  about master plans and plans on land use in the district in accordance with regulations.

5.                   To determine  the city's land use norms and projects in the master plans and plans on land use that the city has allocated to the district to each ward; synthesize and balance land use needs and plan to allocate land use norms of the district to each ward.

6.                   To appraise the dossiers on land allocation, land lease, land recovery, change the land use purpose, grant certificates of land use rights, ownership of houses and other land-attached assets to subjects of authority of the People's Committee of District 8.

7.                   To help the People ‘s Committee of District 8 in implementation of  works of making statistics, inventorying land, making the map of current status of land use.

8.                   To monitor changes in land; to implement making,  managing, updating and adjusting cadastral dossiers, building land information system of district.

9.                   For land disputes between households, individuals and residential  communities, after successful conciliation there is a change in the status of boundaries and land users, the Division of Natural Resources and Environment shall base on the conciliation minutes of the People's Committee of the ward, submit it to the People's Committee of District 8 for a decision to recognize the change of the boundary of the land field and the certificate of land use rights, ownership of houses and other assets attached to the land.

10.                To participate in and coordinate with relevant agencies in determining land prices, land use levy and local land rents fees; to advise the People's Committee of District 8 in land acquisition; chair and coordinate with relevant agencies in implementing the appraisal of  compensation method, support and resettlement plans before submitting them to the People's Committee of District 8 for approval; assist the Chairman of the People's Committee of District 8 to decide on land requisition and extension of land requisition.

11.                To organize to register, confirm and inspect the implementation of environmental protection commitments, simple environmental protection schemes, environmental protection plans and plans for prevention, response and remedy of environmental incidents in the locality; carry out environmental protection work in the locality; make periodic reports on the current status of the environment; propose solutions to environmental pollution, industrial clusters, tourist areas in the locality; collect, manage and store data on water resources, environment and biodiversity in the locality.

12.                To participate in the implementation of solutions to prevent and control invasive alien species; receive and process information and data on genetically modified organisms and products and goods derived from genetically modified organisms, manage genetic resources; participate in organizing the implementation of plans and programs for the conservation and sustainable development of ecosystems, species and genetic resources.

13.                To implement measures to protect the quality of water resources and sources of living water in the locality.

14.                To investigate, make statistics, summarize and classify wells to be filled; inspect and supervise the implementation of the order, procedures and technical requirements in filling wells according to regulations.

15.                To organize for responsing and remedying incidents of water source pollution; monitor, detect and participate in solving water source pollution incidents according to its competence.

16.                To organize the registration of activities of exploitation and use of water resources and discharge of wastewater into water sources according to their competence.

17.                To assist the People's Committee of District 8 to settle according to its competence the lease of land for mineral activities, the use of technical infrastructure and other related issues for organizations and individuals permitted to conduct mineral activities in the locality according to regulations of law.

18.                To assist the People's Committee of District 8 in taking measures to protect unexploited minerals and other natural resources in accordance with the law.

19.                To organize the implementation of the action plan to respond to climate change and participate in updating the action plan to respond to climate change in District 8.

20.                To organize the implementation of regulations of law to protect environment, land resources, water resources, mineral resources.

21.                To monitor and inspect organizations and individuals in the implementation of the law on natural resources and environment; resolve the complaint, report; prevent and combat corruption, waste of resources and the environment in accordance with the law and as assigned by the People's Committee of District 8.

22.                To apply scientific and technological advances; build an information system, store and perform  public services, online public services to serve the State management works of natural resources and environment.

23.                To assist the People's Committee of District 8 in State management to collective economic organizations, private economy in the field of natural resources and environment; participate in the management of organizations and activities of associations and non-governmental organizations in the field of natural resources and environment under the jurisdiction of the People's Committee of District 8.

24.                To guide and inspect the professional and professional State management of natural resources and environment for civil servants specialized in natural resources and environment under the People's Committee of 16 wards, District 8; guide the People's Committees of 16 wards to stipulate the organization, operation and create conditions for the self-governing organization on environmental protection to operate effectively.

25.                To implement works of information and report periodically and irregularly on the performance of assigned tasks in accordance with the regulations of the People's Committee of District 8 and the Department of Natural Resources and Environment of Ho Chi Minh City.

26.                To manage the organizational structure, employment positions, civil servant payrolls, civil servant rank structure, implement salary regimes, policies, remuneration, reward, discipline, training and fostering regimes, professional skills for civil servants and employees under the management of the Division of Natural Resources and Environment in accordance with the law and as assigned by the People's Committee of District 8.

27.                To manage and take responsibility for the finance and assets of the Division of Natural Resources and Environment in accordance with the law.

28.                To help the People's Committee of District 8 manage financial resources and public services in the field of natural resources and environment in accordance with the law.

29.                To perform other tasks assigned by the People's Committee of District 8 in accordance with the law.

CHAPTER II

ORGANIZATION OF APPARATUS AND STAFF

Article 3. Organization of apparatus

The Division of Natural Resources and Environment in District 8 has a Chief of Division and no more than 02 Deputy Chiefs and professional civil servants.

a)                   The Chief of the Division of Natural Resources and Environment is responsible to the People's Committee of District 8, the Chairman of the People's Committee of District 8, and is responsible to the Director of the Department of Natural Resources and Environment for the performance of professional tasks  and under the law on the performance of assigned functions, tasks and powers and all activities of the Division.

b)                   The Deputy Chief of the Division helps the Chief of the Division to take charge and monitor a number of aspects of work; take responsibility before the Chief of the Division and in accordance  with the law for the assigned tasks.

In the absence of the Chief of the Division, a Deputy Chief of the Division is authorized by the Chief to run the activities of the Division.

c) The appointment of the Chief and Deputy Chief of the Division is decided by the Chairman of the People's Committee of District 8 according to the title criteria submitted by the Department of Natural Resources and Environment to the City People's Committee for promulgation and according to the provisions of law.

The dismissal, removal, reward, discipline and other regimes and policies for the Chief and Deputy Chief of the Division shall comply with the provisions of law.

Article  4. Staff

The civil servant payroll of the Division of Natural Resources and Environment is decided by the Chairman of the People's Committee of District 8  on the basis of employment position, associated with functions, tasks, scope of activities and is included in the total payroll of civil servants in administrative agencies and organizations assigned to District 8 by the City People's Committee every year.

Based on the functions, tasks, list of employment positions and rank structure of civil servants approved by competent authorities, the Division of Natural Resources and Environment annually develops a civil servant payroll plan in accordance with law to ensure the performance of assigned tasks.

CHAPTER III

WORKING MODE AND WORKING RELATIONSHIP

Article 5. Working mode

1.                   The Division of  Natural Resources and Environment works under the head regime. The Chief of the Division is in charge of managing all activities of the Division and is in charge of the key tasks. The Deputy Chiefs of the Division are in charge of the areas of work assigned by the Chief of the Division and directly handle arising jobs.

2.                   When handling work in the field under his/her responsibility related to the professional contents of other Deputy Chiefs; The Deputy Chief of the Division actively discussed and agreed on the solution, appointed the Chief of the Division to decide on issues that did not agree with other Deputy Chief of the Division or new problems arise without any guidelines, plans and solutions.

3.                   In case the Chief of the Division directly requests the officers and experts to handle the work within the competence of the Deputy Chief of the Division, such request shall be fulfilled but the officer must report to the Deputy Chief of the Division directly in charge of the matter to know.

Article 6. Meeting mode

1.                   Every week, the leaders of the Division holds a briefing meeting to evaluate the performance of the task and disseminate the work plan for the following week.

2.                   After meeting, the leaders of the Division, the Team Leaders and Deputy Team Leaders meet with the Chief of the Division or Deputy Chief of the Division directly in charge to evaluate the work, discuss the direction of work implementation and agree on the work schedule.

3.                   Based on the annual and monthly work program of the People's Committee of District 8 and the request to solve the work, the Chief of the Division organizes a meeting of all cadres and civil servants once a month.

Extraordinary meetings during the month are only held to deal with unscheduled and urgent works.

4.                   Each member in each team has a working schedule approved by the department's leader directly.

5.                   Working schedule with relevant organizations and individuals, shown in the unit's weekly and monthly work schedule; Working content is carefully prepared by the Division to effectively deal with arising requirements related to the Division's professional activities.

Article 7. Working relationship

1.     For the Department of Natural Resources and Environment and relevant agencies:

The Division of Natural Resources and Environment is subject to the professional guidance and examination of the Department of Natural Resources and Environment, and implement the periodically reports on professional work and at the request of the Director of the Department of Natural Resources and Environment.

Appoint officers to coordinate with relevant agencies to conduct inspection and examination in the field of natural resources and environment in District 8 when required:

2. For the People’s Committee of District 8:

The Division of  Natural Resources and Environment is under the direct and comprehensive leadership and direction of the People's Committee of District 8 for all work according to the functions and tasks of the Division, the Chief of the Division directly receives the direction and contents of works from the Chairman or Vice Chairman in charge of the division and must regularly report to the Standing Committee of the People's Committee of District 8 on the assigned tasks;

Periodically report to the People's Committee of District 8 on the contents of the Division's work and propose measures to solve professional work in State management in related fields.

3. For Office of Land Registration of  Ho Chi Minh City, Branch of Office of Land Registration of  District 8:

- To ensure the implementation,  coordinate synchronously, consistently, closely, timely, publically, transparently and strictly, comply with the provisions of law and relevant guiding documents.

- To clearly identify the agency or unit in charge and coordination; responsibilities and powers of the head of the agency or unit; content, time limit and method of implementation; information and reporting regime.

- To comply with the provisions of current laws; consistent with the functions, tasks, powers, organization and operation regulations of each agency or unit.

4. For other specialized agencies under the People's Committee of District 8

To implement cooperation and coordination relationships on the basis of equality, according to functions and tasks, under the general management of the People's Committee of District 8, in order to ensure the completion of political tasks and economic and social plans of District 8. In case the Division of Natural Resources and Environment is in charge of coordinating to solve the work, if not agreeing with the opinion of the Heads of other specialized agencies, the Chief of the Division of Natural Resources and Environment shall gather opinions and submit them to the Chairman of the District 8 People's Committee for consideration and decision.

5. For the Vietnam Fatherland Front Committee of District 8, career units, departments, branches, unions, social organizations of District 8:

When the Vietnam Fatherland Front Committee of District 8, career units, departments, branches, unions, social organizations of District 8 have requirement, request in matters falling within the functions of the Division, the Chief of the Division is responsible for presenting, settling or submitting to the People's Committee of District 8 for settlement such requests according to his/her competence. At the same time, coordinate to organize communication activities on climate change and environmental protection according to the annual plan.

6. For People’s Committee of 16 wards:

a) To coordinate to support and create conditions for People's Committees of wards to carry out State management contents related to the functions and tasks of the Division.

b) To guide cadres and civil servants of the People's Committee of 16 wards on the professional and professions of the branches and fields of work managed by the Division.

CHAPTER IV

 ENFORCEMENT PROVISIONS

Article 8. Pursuant to this Regulation, the Chief of the Division of Natural Resources and Environment of District 8 is responsible for specifying the functions and duties of the Division; powers, responsibilities, titles and standards of civil servants of the Division in accordance with the characteristics of the locality but not contrary to the content of this Regulation, submitted to the People's Committee of District 8 for decision to implement.

Article 9. The Chief of the Division of Natural Resources and Environment and the heads of relevant agencies and units and the Chairman of the People's Committee of 16 wards, District 8 are responsible for implementing the Regulation on organization and operation of the Division of Natural Resources and Environment after promulgated by the People's Committee of District 8. In the course of implementation, if problems arise beyond their competence, they will study and propose to the People's Committee of District 8 to consider, resolve or add and amend the Regulation to be suitable./.
